Welcome to Nuit Out, a social activity community. By participating in any activity organized by Nuit Out, you acknowledge and agree to the following Terms of Service.
1. Assumption of Risk
You understand that activity and related activities involve inherent risks, including but not limited to injuries, falls, collisions, weather-related hazards, traffic accidents, and unforeseen medical conditions. You voluntarily participate in Nuit Out at your own risk and assume full responsibility for any injury or damage that may occur.
2. Waiver of Liability
By participating in Nuit Out, you agree to release, waive, and discharge Nuit Out, its organizers, volunteers, and affiliates from any liability, claims, demands, or causes of action arising out of or related to any injury, death, or property damage occurring during or as a result of participation in any Nuit Out event.
3. Medical Fitness and Responsibility
You affirm that you are in good health and physically capable of participating in Nuit Out activities. You acknowledge that it is your sole responsibility to seek medical advice before engaging in physical activity and to monitor your own physical condition. In the event of an emergency, you consent to receiving medical assistance if necessary, but understand that Nuit Out assumes no responsibility for medical care.
4. Code of Conduct
All participants are expected to behave responsibly and respectfully toward others, follow local traffic laws, and remain aware of their surroundings. Any form of harassment, discrimination, or reckless behavior will not be tolerated and may result in exclusion from Nuit Out events.
5. No Guarantees or Insurance
Nuit Out does not provide insurance coverage for participants. You acknowledge that you are responsible for your own safety and personal belongings. We encourage all participants to carry personal health insurance and to take appropriate precautions during participation.
6. Weather and Cancellations
Events may be canceled or rescheduled due to weather conditions or other unforeseen circumstances. It is your responsibility to check for updates before attending any event.
7. Photo and Media Release
By participating in Nuit Out, you consent to being photographed or recorded, and you grant Nuit Out permission to use such media for promotional and social media purposes. If you do not wish to be included in photos or videos, please inform the event organizers in advance.
8. Changes to These Terms
Nuit Out reserves the right to modify these Terms of Service at any time. Participants will be notified of any significant changes.
9. Governing Law
These Terms are governed by the laws of the jurisdiction where we are located. Any disputes arising under these Terms will be resolved in the courts of the jurisdiction where we are located.
